Campaign launched for asteroid-hunting telescope
Leaders of the B612 Foundation explain their plan to launch the first privately funded deep-space mission, aimed at mapping the inner solar system.

Leaders of the nonprofit B612 Foundation today took the wraps off a campaign to fund and launch a space telescope to hunt for potential killer asteroids?? a campaign they portrayed as a cosmic civic improvement project.
Former NASA astronaut Ed Lu, the foundation's chairman and CEO, estimated that hundreds of millions of dollars would have to be raised to fund the project, but said he was "confident we can do this."
"We've been at this particular project for a year now," Lu told me in advance of today's campaign kickoff at the California Academy of Sciences' Morrison Planetarium in San Francisco. "We have people who are internationally well-connected, and we have a message that we think resonates with people ranging from large donors to perhaps half a million kids worldwide."
The foundation's aim is to identify and map the orbits of half a million asteroids that are on trajectories approaching Earth over the course of five and a half years, using a spacecraft that's launched into a Venus-type orbit on a SpaceX Falcon 9 rocket in the 2017-2018 time frame.
Apollo astronaut Rusty Schweickart, B612's chairman emeritus, said the task could be key to humanity's long-term survival.?"We feel a certain urgency to get on with it so that we can be confident that we're not going to have a cosmic disaster here for no good, justifiable reason, just because we didn't get with it," he said in a statement. "So let's get with it. That's the name of the game."
What's the risk?
The potential risk posed by near-Earth asteroids was highlighted earlier this month when a kilometer-wide (0.6-mile-wide) asteroid called 2012 LZ1 sailed within 3.3 million miles (5.3 million kilometers) of our planet, just a few days after its discovery. If a rock that big were to hit Earth, it could end civilization as we know it. Smaller asteroids, around 40 meters (130 feet) in diameter, could set off atom-bomb-scale explosions?like the 1908 Tunguska impact, which flattened 500,000 acres (2,000 square kilometers) of forest in Siberia.
Ground-based telescopes and space probes such as the NASA's now-defunct Wide-field Infrared Survey Explorer have found thousands of near-Earth asteroids, including an estimated 90 percent of the planet-killers measuring a kilometer or more wide. But there are hundreds of thousands more yet to be found in the Tunguska-or-bigger range.
The B612 Foundation, which takes its name from the asteroid that was home to the main character in a children's book titled "The Little Prince," was formed in 2002 to advocate strategies for deflecting potentially hazardous asteroids. A little more than a year ago, the foundation decided to shift its focus to mapping the inner solar system.
"Over the years it became clear that deflecting asteroids is a solvable technical problem as long as there is adequate early warning (decades of notice)," the foundation said in a briefing paper. "It also became clear that the job of tracking asteroids to provide early warning was not going to be accomplished by others in a timely fashion."
What's the mission?
To track more asteroids, the foundation proposes launching the Sentinel Space Telescope, a 1.5-ton, 25-foot-tall (7.7-meter-tall) observatory that draws upon design features from NASA's Spitzer Space Telescope and Kepler planet-hunting probe. Ball Aerospace was involved in both those earlier space projects, and would be the prime contractor for the Sentinel. The craft would carry a 20-inch (50-centimeter) telescope with an infrared imager.
Lu said the telescope's design has been nearly completed under the leadership of mission director Harold Reitsema, an astronomer who recently retired from Ball Aerospace. Negotiations are currently under way with Ball Aerospace on a fixed-price contract to build the Sentinel, Lu said. He declined to be specific on the mission cost because of those negotiations.
The mission plan calls for the craft to be launched on a Falcon 9 into a slightly elliptical orbit between Earth and Venus. From that vantage point, the Sentinel could look out toward the vicinity of Earth's orbit with the sun behind it?? which would be ideal for spotting space rocks like 2012 LZ1. Image data would be beamed down to NASA's Deep Space Network and passed along to the mission's data operations center at the Laboratory for Space Physics in Boulder, Colo. Newly identified asteroids would be reported to the International Astronomical Union's Minor Planet Center, in accordance with existing procedures, and the orbital data would be analyzed by NASA's Jet Propulsion Laboratory to assess potential hazards.
The B612 Foundation said it signed a Space Act Agreement with NASA on June 19 in support of the mission. The foundation has also been in contact with SpaceX's engineers to discuss technical details for the anticipated launch, Lu said.
What are the chances?
The fund-raising challenge could be as daunting as the challenges associated with spacecraft development. But Lu said the success of SpaceX's commercial resupply mission last month boosted his confidence that a non-governmental space effort could be successful. After his 2007 retirement from NASA's astronaut corps, Lu worked for three years as a Google executive, and he was inspired to go forward with the Sentinel project when he returned to Google's Silicon Valley headquarters to give a talk.
"I told them the essential problem was that nobody is mapping the asteroids," he recalled. "One of the guys there said, 'Why don't you just go and do it?' ... And then we said, 'Hey, maybe we can.' It was eye-opening to me to see how commonplace these types of fund-raising projects are."
Lu pointed out that the estimated cost of the mission, amounting to a few hundred million dollars, was comparable to the cost of building a performing arts center, a museum, or a planetarium like the one where today's briefing was being held. The San Francisco Museum of Modern Art, for example, has raised more than $437 million in its current capital campaign. "There are 50 to 100 projects larger than ours going on at any time in the United States, and nobody bats an eye," he said.
He also recalled that many of the world's best-known observatories, including the Palomar Observatory, the Lick Observatory and the Keck Observatory, were built with private financing. "I think of this as following in the precedent of large ground-based telescopes, from a funding standpoint," Lu said.?
It would be nearly unprecedented, however, to mount a space mission exclusively with private donations. The nonprofit Planetary Society and Cosmos Studios tried to do so in 2005 when they financed the launch of the Cosmos 1 solar sail on a Russian submarine missile ??but that $4 million mission failed, and the follow-up LightSail 1 mission has not yet been launched.
NASA looked into launching an asteroid-hunting probe years ago, but never went forward with the mission because it was deemed too expensive. The cost was estimated at $500 million nine years ago, Tim Spahr, director of the Minor Planet Center, told The Associated Press.
Spahr questioned whether enough could be raised for the Sentinel project, given the state of the economy. "This is a hard time," he told AP.
The B612 Foundation's list of directors and advisers include some well-known names in the fields of fund-raising and venture capital, such as Dick Bingham, Geoff Baehr, Esther Dyson, Alexander Galitsky and Steve Jurvetson. Other members of the "B612 Founders Circle" include Google senior vice president Alan Eustace, Broadcom President/CEO Scott McGregor and Reddit CEO Yishan Wong. In the end, fund-raising power may be as essential for the Sentinel's successful liftoff as SpaceX's Falcon 9 rocket.

Chinese astronauts parachute land after mission
A Chinese space capsule with three astronauts aboard returned to Earth on Friday from a 13-day mission to an orbiting module that is a prototype for a future permanent station.
The crew of the Shenzhou 9 parachuted to a landing on the grasslands of the country's sprawling Inner Mongolia region at about 10 a.m. (0200 GMT). China declared the mission to the Tiangong 1 module a major stride ahead for the country's ambitious space program.
The crew included China's first female astronaut, 33-year-old Liu Yang, who was joined by mission commander and veteran astronaut Jing Haipeng, 45, and crew mate Liu Wang, 43. All are highly experienced air force pilots.
The mission had included both remote control and piloted dockings with the module and extensive medical monitoring of the astronauts as part of preparations for manning a permanent space station.
China's next goals include another manned mission to the module originally scheduled for later this year but which may be delayed depending on an evaluation of the Shenzhou 9 mission and the condition of the Tiangong 1. China has been extremely cautious and methodical in its manned missions, with more than three years passing since the previous one, and all four have been relatively problem-free.
Tiangong 1 is due to be retired in a few years and replaced with a permanent space station around 2020 that will weigh about 60 tons, slightly smaller than NASA's Skylab of the 1970s and about one-sixth the size of the 16-nation International Space Station that China was barred from participating in, largely on objections from the United States. Possible future missions could include sending a rover to the moon, possibly followed by a manned lunar mission.
Launched June 16 from the Jiuquan center on the edge of the Gobi desert in northern China, Shenzhou 9 is the latest success for China's manned space program that launched its first astronaut, Yang Liwei, into space in 2003, making China just the third nation after Russia and the U.S. to achieve that feat. China would also be the third country after the United States and Russia to send independently maintained space stations into orbit.
Earlier in the week, a spokeswoman said China spent 20 billion yuan ($3.1 billion) on its space program between 1992 and 2005 - a rare admission for a program with close links to the secretive military. By the time the next Shenzhou mission is completed, Beijing will have spent an additional 19 billion yuan ($3 billion), the spokeswoman said.

How to Make Beef Steak Recipes:
1. Marinate meat with nutmeg, pepper, salt. Heat the butter, put the meat. Fry until browned, cooked

San Antonio police and fire crews were at the scene of a roll-over accident Thursday afternoon.
The accident took place at around 3:30 p.m. Thursday in the 1900 block of SE Military.
Police say that one person was ejected from the vehicle and another person is trapped inside.

Daron Sutton has been the Diamondbacks? television play-by-play announcer since 2007, but last week he was removed from the team?s broadcasts without explanation.
Senior vice president of communications Josh Rawitch said only that ?we?ve made a change in the broadcast-talent lineup? and ?Daron will be taking some time off.?
Dan Bickley of the Arizona Republic finds the whole situation very odd, writing: ?You can?t remove a play-by-play guy out of the broadcast booth during the middle of the season without explanation, from a team with great television ratings, at a time when the Diamondbacks are finally finding a groove, and expect muted compliance from the masses.?
And yet the Diamondbacks have done just that, with managing general partner Ken Kendrick declining to comment yesterday except to say it was ?a personal matter? and ?I suspect the situation will become clear soon enough.?
Adding to the drama is that Sutton is scheduled to work the FOX national game Saturday, which is Diamondbacks versus Brewers.

BEIRUT (AP) ? A Syrian general was among the latest defectors from the Syrian military, officials said Monday, after dozens of Syrian soldiers fled overnight to Turkey, crossing the border with their families.
The general defected in recent days, Turkish officials said. Then, according to the state-run Anadolu news agency, 33 soldiers crossed the border overnight, including a second general and two colonels.
But a Turkish government official, who spoke on condition of anonymity in line with government rules, said the group included three colonels, and there was no general.
The two accounts could not immediately be reconciled.
Thousands of soldiers have abandoned the Syrian regime, but most are low-level conscripts. The rebel Free Syrian Army ? which is based in Turkey ? is made up largely of defectors.
Anadolu said a total of 224 people crossed into Turkey overnight, the latest blow to Syrian President Bashar Assad's regime.
The officer who defected separately in the last few days was a brigadier general, Turkish officials said. In January, a brigadier general appeared in Turkey, the highest ranking officer to defect up to that point.
Activists say more than 14,000 people have been killed since the uprising began in March 2011, and the death toll mounts every day.
There are widespread fears that the conflict could spark regional unrest ? and those fears mounted Friday when Syrian forces shot a Turkish military plane out of the sky.
Syria insists that the Turkish plane violated its air space. But Turkey disagrees, saying that though the plane had unintentionally strayed into Syria's air space, it was inside international airspace when it was brought down.
In recent days, both sides appeared to be trying to calm tensions over the incident.
Syria's Foreign Ministry spokesman said Monday his country has "no hostility" toward Turkey.
"We behaved in a defensive and sovereign way," Jihad Makdissi said in the Syrian capital. He said the search was still under way for two missing Turkish airmen who were on the plane.
Ankara has called a meeting of NATO's governing body on Tuesday to discuss the incident. Allies can request such consultations if they feel their territorial integrity or security are threatened.
Turkey's Energy Minister, Taner Yildiz, meanwhile, suggested Turkey will cut electricity supplies to Syria. Turkish companies provide Syria with around 10 percent of Syria's annual power consumption. Yildiz said a decision on the issue could be announced Tuesday.
Turkish Prime Minister Recep Tayyip Erdogan is expected to address legislators in parliament Tuesday and reveal what measures Turkey will take against Damascus for downing down the plane.
Also Monday, the Red Cross said hundreds of civilians are trapped in the Syrian city of Homs and aid workers cannot reach them because of the fighting. Homs has been one of the hardest-hit areas in Syria as regime forces try to crush the opposition.
The defectors who crossed into Turkey overnight were brought to a refugee camp in Hatay, a province bordering Syria. Turkey is host to some 33,000 Syrians who are seeking refuge from the violence.

Timing of ADHD medication affect academic progress
ScienceDaily (June 25, 2012) ? A team of researchers led by an epidemiologist at Mount Sinai School of Medicine and University of Iceland has found a correlation between the age at which children with attention-deficit/hyperactivity disorder (ADHD) begin taking medication, and how well they perform on standardized tests, particularly in math.
The study, titled, "A Population-Based Study of Stimulant Drug Treatment of ADHD and Academic Progress in Children," appears in the July, 2012, edition of Pediatrics, and can be viewed online on June 25. Using data from the Icelandic Medicines Registry and the Database of National Scholastic Examinations, the researchers studied 11,872 Icelandic children born between 1994 and 1996. The children started medication for ADHD at different times between fourth and seventh grades.
The findings showed that children who began drug treatment within 12 months of their fourth-grade test declined 0.3 percent in math by the time they took their seventh-grade test, compared with a decline of 9.4 percent in children who began taking medication 25-to-36 months after their fourth-grade test.
The data also showed that girls benefited only in mathematics, whereas boys had marginal benefits in math and language arts.
"Children who began taking medications immediately after their fourth-grade standardized tests showed the smallest declines in academic performance," said the study's lead author Helga Zoega, PhD, Post Doctoral Fellow of Epidemiology at Mount Sinai's Institute for Translational Epidemiology. "The effect was greater in girls than boys and also greater for children who did poorly on their fourth grade test."
Stimulants are widely used in the United States as a therapeutic option for children with inattention, impulsivity, and hyperactivity associated with ADHD. The medications are less frequently used in Europe, although their use in Iceland most closely resembles the U.S. Long-term follow-up studies of stimulant use and academic performance are scarce, according to the researchers.

Four killed after light plane crashes in Oregon

A small plane crashed soon after taking off from a private airstrip in Oregon timber country Saturday and killed all four people on board, authorities said.?
The small plane went down around 3:10 p.m. in a rural area west of Eugene, according to the Lane County Sheriff's Office.
Citing witness reports, authorities said the plane began to lose altitude shortly after take-off and hit a large tree that Lane County District No. 1 Fire Chief Terry Ney said tore off a wing of the aircraft.?
The single-engine Cessna landed upside down, Ney said. Fire authorities pronounced the four people inside the aircraft dead at the scene.?
Details about the victims and their names were being held pending notification of next of kin.?
The National Transportation Safety Board was en route Saturday to investigate the crash while the sheriff's office helped secure the scene.?
Lane County records show the airstrip where the plane took off is owned by Conrad Magnuson and known as Crow-Mag Airport, according to a report by Mark Baker in the Eugene Register-Guard.
The newspaper said Magnuson declined to be interviewed when approached at his home.
??It?s going to take heavy tools to get them out of there,? Lane County District No. 1 Fire Chief Terry Ney said of the victims. The small plane ?for whatever reason didn?t clear the woods,? Ney said.
Nearby resident Debbie Parker told the newspaper she had just gotten home Saturday afternoon and was unloading groceries when she heard the plane overhead.
?Didn?t sound real strong,? Parker said, sitting on her deck. ?And then I heard it crash.?
Some people associated with the nearby Oregon Country Fair property came by Saturday and thought the crash victims might be associated with the fair, she added.

Turkey takes jet downing to NATO, Syria tension soars
NATO said on Sunday it will discuss Turkey's accusation that Syria shot down one of its warplanes in international airspace, as Damascus suffered heavy casualties and violence scaled new heights.
Syria's surging bloodshed saw at least 72 people killed, a bulk of them soldiers in fighting with rebels, activists said.
Turkish Foreign Minister Ahmet Davutoglu warned Ankara's southern neighbour not to challenge Turkey's military.
And Britain, another member of the North Atlantic Treaty Organisation, offered support for "robust" international action.
Davutoglu told Turkey's TRT television that, "according to our conclusions, our plane was shot down in international airspace, 13 nautical miles from Syria."
Damascus did not issue a warning before shooting down the plane, which was on an unarmed training mission to carry out a radar system test, Turkey said.
"The Syrians knew full well that it was a Turkish military plane and the nature of its mission," he said. "Nobody should dare put Turkey's (military) capabilities to the test."
US Secretary of State Hillary Clinton lashed out at Syria for the "brazen and unacceptable" downing of the Turkish jet and vowed to work with Ankara on a suitable response.
"It is yet another reflection of the Syrian authorities' callous disregard for international norms, human life, and peace and security," Clinton said in a statement.
British Foreign Secretary William Hague said President Bashar al-Assad's regime "should not make the mistake of believing that it can act with impunity. It will be held to account for its behaviour."
Italy, another NATO member, also condemned the regime for the shooting incident. "This is ... extremely serious and unacceptable," Foreign Minister Giulio Terzi said.
He added that Rome voiced its "strong indignation and condemnation" and that Italy would "actively participate" in the NATO meeting, which is to be held on Tuesday.
A NATO spokeswoman said that, "under Article 4, any ally can request consultations whenever, in the opinion of any of them, their territorial integrity, political independence or security is threatened."
Damascus said it downed the F-4 Phantom on Friday after it violated Syrian airspace.
"Syria was merely exercising its right and sovereign duty and defence," Syrian foreign ministry spokesman Jihad Makdissi was quoted as saying on Sunday in Al-Watan, a pro-government daily.
"There is no enmity between Syria and Turkey, but political tension (exists) between the two countries.
"What happened was an accident and not an assault as some like to say, because the plane was shot while it was in Syrian airspace and flew over Syrian territorial waters," Makdissi said.
Turkey acknowledged on Saturday that the plane may have done so, in comments seen as a bid to cool tensions between the former allies, but it now appears to have taken a harder stance.
CNN-Turk television reported that search and rescue teams have located the wreckage of the jet at a depth of 1,300 metres (4,265 feet) in the sea, but did not give its precise location or refer to the fate of the two missing pilots.
Ankara said it could not confirm the report.
"We will bring this affair before public opinion and international law in the name of Turkey's honour," Davutoglu said.
Turkish-Syrian relations have already been strained by Prime Minister Recep Tayyip Erdogan's outspoken condemnation of the Assad's regime's bloody crackdown, which rights activists say has killed more than 15,000 people since March 2011.
UN chief Ban Ki-moon expressed his "deep concern" about the incident, particularly about the "potential serious implications" for the region, spokesman Martin Nesirky said.
In a telephone call with Davutoglu, the UN chief "commended Turkey for the restraint shown in its initial reaction and appreciated Turkey and Syria for conducting a joint search operation."
At least 72 people were killed on Sunday in Syria, including 36 civilians, 27 soldiers and nine rebels, the Syrian Observatory for Human Rights said.
At least 16 soldiers were killed in the northern province of Aleppo, while the rest died in neighbouring Idlib province and in the provinces of Damascus and Deir Ezzor in the east, the watchdog said.
The Observatory reported that following an attack on an artillery battalion in Aleppo, a number of soldiers defected, taking with them a large quantity of weapons.
The official SANA news agency reported that regime troops "were engaged in combat against a terrorist group that attacked people in the Jabaliye neighbourhood of Deir Ezzor killing scores of terrorists."
Syrian government uses the term "terrorists" to describe the rebels.
In another setback for the regime, rebels captured 11 government soldiers in the central province of Damascus, it added.
"This is one of the bloodiest weeks in the conflict," Rami Abdel Rahman, head of the Observatory, said.
The Observatory also reported that rebels had shot down a Syrian regime helicopter near the Jordanian border.
According to Observatory figures, 94 people were killed in Syria last Monday, 62 on Tuesday, 88 on Wednesday, 168 on Thursday, 116 on Friday and 116 more on Saturday.
"It's like we are in a war," Abdel Rahman said. "Sometimes when two countries are at war, not even 20 people are killed a day. But now in Syria it has become normal to have 100 killed each day."
A Russian ship that tried to deliver attack helicopters to Syria entered the northern port of Murmansk on Sunday after being forced to turn back when news of its mission was leaked.
An unnamed Russian diplomat said the ship, the Alaed, would soon try again to make the highly controversial delivery under the Russian flag.
The switch appears to be an attempt to avoid security inspections that come when sailing under the flag of a third country.
The Alaed was forced to turn back after its mission was initially mentioned by the US State Department and then reported in the British press. Those reports prompted the ship's British insurer to withdraw coverage.

If the recent chapter in Olympus' history was a photo, it'd be a blurry thumb covering the subject's head. But, if reports from Nikkei are correct, it looks like the next one might be a happy family portrait. As suggested earlier this year, Sony is reportedly close to agreeing on a 50 billion yen (about $620 million) investment in the scandalized firm. This would likely give the Japanese electronics giant a 10 percent stake in Olympus, making it the largest single shareholder. This isn't the first time we've seen the troubled camera and optics brand associated with other electronics firms, and with Olympus telling Reuters that "This is not something that we have announced" we'll just have to wait and see exactly how this next frame develops.

Apple hits HTC with counterclaim lawsuit for failure to FRAND license 4G patents
It's been far too quiet on the litigation front here at Engadget lately, but thankfully Apple's broken our courtroom news dry spell with a freshly filed counterclaim in the Eastern District of Virginia federal court. FOSS Patents reports that Apple's target is HTC, who Apple claims has abused two patents essential to the 4G/LTE wireless standard by using them in a legal action against Cupertino. In doing so, Apple asserts HTC breached its FRAND licensing obligations. The counterclaim was filed in response to an HTC-initiated complaint in the ITC, and comes hot on the heels of Apple's recent win in that case where it managed to exclude some Google patents that the Taiwanese firm borrowed to take Apple down. Parents - not TV - may determine whether kids are active or couch potatoes
ScienceDaily (June 21, 2012) ? Researchers at Oregon State University have confirmed what we knew all along -- children in this country are increasingly sedentary, spending too much time sitting and looking at electronic screens.
But it's not necessarily because of the newest gee-whiz gadgets -- parents play a major factor in whether young children are on the move.
In two studies out online June 21 in a special issue of the journal Early Child Development and Care devoted to "Parental Influences of Childhood Obesity," OSU researchers examined how parenting style -- whether a strict but loving parent or a less-involved and more permissive parent -- was associated with sedentary behavior.
Overall, they found that children who had "neglectful" parents, or ones who weren't home often and self-reported spending less time with their kids, were getting 30 minutes more screen time on an average each week day.
More disturbing to lead author David Schary -- all of the children ages 2 to 4 were sitting more than several hours per day.
"Across all parenting styles, we saw anywhere from four to five hours a day of sedentary activity," he said. "This is waking hours not including naps or feeding. Some parents counted quiet play -- sitting and coloring, working on a puzzle, etc. -- as a positive activity, but this is an age where movement is essential."
Schary, a doctoral student in the College of Public Health and Human Sciences at OSU, said parents were grouped into four commonly used scientific categories -- authoritarian (high warmth and control), authoritative (controlling, less warm), permissive (warm, low control), and neglectful (low control and warmth).
While all the children in the sample of about 200 families were sitting four to five hours in a typical day, parents in the more neglectful category had children who were spending up to 30 additional minutes a day watching television, playing a video game or being engaged in some other form of "screen time."
"A half an hour each day may not seem like much, but add that up over a week, then a month, and then a year and you have a big impact," Schary said. "One child may be getting up to four hours more active play every week, and this sets the stage for the rest of their life."
Some might wonder whether parents who were less participatory during the week days made up for it during the weekends. Actually, just the opposite happened. Sedentary time increased nearly one hour each weekend day.
Bradley Cardinal, a professor of social psychology of physical activity at OSU, co-authored both papers with Schary. Cardinal said sedentary behavior goes against the natural tendencies of most preschool-age children.
"Toddlers and preschool-age children are spontaneous movers, so it is natural for them to have bursts of activity many minutes per hour," he said. "We find that when kids enter school, their levels of physical activity decrease and overall, it continues to decline throughout their life. Early life movement is imperative for establishing healthy, active lifestyle patterns, self-awareness, social acceptance, and even brain and cognitive development."
In a separate study, Schary and Cardinal looked at the same group of participants and asked about ways parent support and promote active play. They found that parents who actively played with their kids had the most impact, but that any level of encouragement, even just watching their child play or driving them to an activity -- made a difference.
"When children are very young, playing is the main thing they do during waking hours, so parental support and encouragement is crucial," Schary said. "So when we see preschool children not going outside much and sitting while playing with a cell phone or watching TV, we need to help parents counteract that behavior."

Expert: Poor plan led to Calif cop-on-cop shooting
LOS ANGELES (AP) ? Knowing that one of their officers was having sex with a 17-year-old Explorer, police in the central coast city of Santa Maria hatched a plan to immediately arrest him after he indicated he would rather kill himself than go to jail.
Use-of-force experts are split on whether that decision was the right call. The result was fatal shooting of the officer by a colleague while on duty at a DUI checkpoint.
Although local prosecutors deemed the shooting legally justified this week, it is the subject of a pair of independent investigations that will examine the department's response.
"In order to minimize the potential of serious injury or death, this is the worst plan they could have come up with by confronting him at the scene with the information they had," said William Flynn, a retired lieutenant with the West Covina Police Department. "This simply didn't have to happen," said Flynn, who reviewed an 18-page report about the shooting.
Officer Matt Kline, a five-year veteran, killed Officer Alberto Covarrubias early Jan. 28 as two sergeants tried to wrestle a loaded handgun from him. Covarrubias fired a round before being shot.
Kline was not only a friend of Covarrubias, he had been best man at his wedding weeks earlier.
The shooting rocked Santa Maria, a city of 100,000 in an agricultural region about 150 miles northwest of Los Angeles.
Covarrubias, part of a 112-officer force, was under investigation for having sex with a teenage girl who was part of the police Explorer program. Police used a ruse by having the girl call Covarrubias and tell him she might be pregnant with his child. Covarrubias asked the girl to deny they had sex and said he would kill himself before facing the prospect of going to jail.
"Based on the information at hand, it was decided it was necessary to act immediately and arrest the officer," the Santa Barbara County district attorney's office said in the report.
One factor made the situation even more tenuous: Covarrubias was aware police were investigating an undisclosed incident involving an Explorer and suspected the probe was focused on him and the teenage girl.
"If I get caught I'm done," Covarrubias texted the girl the night before the shooting, according to the report. He added, "Let's not worry."
Flynn said instead of formulating a plan to isolate Covarrubias, Santa Maria police tried to arrest him on duty at the DUI checkpoint where there were other armed officers unaware of what was going on. Flynn said police had various options at their disposal, including waiting until Covarrubias had returned to the station.
"In this situation they needed to deescalate it, but in my opinion they did nothing but escalate it," he said. "They are lucky no other officers were injured."
Gregory D. Lee, a criminal justice consultant and retired supervisory special agent for the Drug Enforcement Administration, said because Covarrubias saw his life crumbling, police had to make the arrest sooner than later.
"They thought it was time-critical," Lee said. "You don't know how people are going to react to certain situations. I think they used their best judgment at the time."
City Manager Rick Haydon said there are two parallel independent investigations that will look at how police handled the incident. One is being handled by two retired law enforcement officers as part of an internal affairs investigation. The other will be conducted by the Office of Independent Review, a Los Angeles County law enforcement watchdog agency.
Haydon declined to comment further about the prosecutor's report on the shooting, only to say it was comprehensive and "very detailed."
Kline remains on paid administrative leave.
Covarrubias's family has filed a claim, a precursor to a lawsuit, against the city of Santa Maria. The family's attorney, Gil Alvandi, said his office is conducting its own investigation and he disagrees that the fatal shooting was justified.
"We feel that the investigation was conducted with a predetermined outcome clearing the city and its officials of any wrongdoing," Alvandi said. "The attempt to protect officials at the highest levels of the police department is blatant and unacceptable."
Alvandi pointed out there were roughly a dozen instances where police brass showed concern with the plan to arrest Covarrubias but it went ahead anyway in a "reckless and haphazard manner."
One of the sergeants who tried to get the gun away from Covarrubias, who happened to be his cousin, questioned before the shooting why they had to make the arrest that night. A lieutenant responded that Covarrubias may be suicidal and wasn't going to be taken alive, according to the report.
"This is about the worst case scenario you can come up with," Lee said. "It's 'Peyton Place.' It's a mess."
