WASHINGTON (Reuters) - The Pentagon warned on Thursday that it was considering legal action against a former U.S. Navy SEAL for material breach of non-disclosure agreements with his his first-hand account of the raid that killed Osama bin Laden.
In a letter obtained by Reuters, and subsequently released by the Pentagon, the Pentagon's top attorney also warned that it was also considering legal options against anyone "acting in concert" with the author.
The letter, addressed to "Mark Owen," the pseudonym under which the book was written, identified two separate non-disclosure agreements he signed with the Navy that legally committed him to never divulge classified information.
"You are in material breach and violation of the non-disclosure agreements you signed," the letter by Jeh Johnson, the Pentagon's General Counsel, said.
"The Department of Defense is considering pursuing against you, and all those acting in concert with you, all remedies legally available to us in light of this situation."
U.S. officials said last week they were surprised by the book, which was not vetted by government agencies to ensure that no secrets were revealed.
The book has received widespread media coverage and the Pentagon letter noted that some copies have already been released, even ahead of the book's formal release next week.
"Further public dissemination of your book will aggravate your breach and violation of your agreements," the letter warned.
Earlier this week, the author said in a statement from his publisher that the book was written "with respect for my fellow service members while adhering to my strict desire not to disclose confidential or sensitive information that would compromise national security in any way."
But many in the special operations community have privately expressed disappointment in recent days over the book and the publicity it has received.
The author now faces threats against his life. An official al Qaeda website last week posted a photograph and the real name of the former Navy commando, calling him "the dog who murdered the martyr Sheikh Osama bin Laden."

"The Secret Race: Inside the Hidden World of the Tour de France: Doping, Cover-ups, and Winning at All Costs," is now scheduled for release Sept. 5.
Ballantine Bantam Dell touts the book as the "first deeply detailed window into one of the defining sports stories of our time."
Armstrong said last week he would not pursue arbitration in a case brought by the U.S. Anti-Doping Agency, which stripped his record seven Tour de France titles.
Included in the case was Hamilton's interview with "60 Minutes" claiming he had personal knowledge of Armstrong doping.
Armstrong has steadfastly denied doping but said he was tired of fighting USADA.

The New York Roman Catholic leader made the announcement Tuesday through his spokesman.
After GOP presidential candidate Mitt Romney announced last week that Dolan would offer the benediction at this week's Republican Convention in Tampa, Fla., some Catholic liberals criticized Dolan's appearance. They said it gave the impression he was endorsing Romney.
Dolan, president of the U.S. bishops' conference, is also an outspoken critic of President Barack Obama's mandate that employers provide health insurance that covers birth control.
Dolan said he was participating only to give a prayer.
Separately, Democrats said Tuesday that Sister Simone Campbell of the Catholic nuns' lobby group NETWORK will give an address at the convention next week.

A Tennessee man who murdered his wife in a bathtub for the life insurance money has been allowed to keep $200,000 of her insurance settlement.
The strange case began in 2003 when Teresa Larkin was found dead by her then-11-year-old daughter Tia in the Johnson City home they shared with Dale Keith Larkin, Tia's stepfather. A partial autopsy was performed on the body but no X-rays were taken prior to burial, according to The Associated Press.
Larkin stood to collect a total of $700,000 on four life insurance policies in his wife's name before his stepdaughter, who suspected Larkin of the murder, filed a lawsuit to block the windfall.
In 2006, the suit was settled with Tia receiving $500,000 and Larkin getting $203,000 of the death benefits.
Three years later, Johnson City homicide investigators convinced prosecutors to exhume the body, and a second autopsy was performed. It revealed that the victim had suffered 21 separate injuries, including breaks to her sternum and both arms, prior to drowning.
Charges were filed against Larkin, who was subsequently convicted of his wife's murder and sentenced to life in prison in 2011.
Tia Larkin returned to court to recover Dale Larkin's share of the life insurance settlement, claiming her stepfather had misrepresented his innocence and citing Tennessee's "slayer's statute" that prohibits those involved in murder from inheriting from the deceased.
Life insurance generally bars murderers from receiving proceeds from their victim's life policy just as common law forbids individuals from profiting from wrongdoing. And a life insurance company doesn't require an actual?murder conviction to deny a claim; intentional neglect or even want of an "insurable interest" in the insured can be enough to block payment of the death benefit.
But the appellate court ruled that the stepdaughter freely agreed to split the life insurance settlement with Larkin, even though she did not believe he was innocent.
"This court is not happy with the results of our decision," wrote Appellate Judge D. Michael Swiney in the opinion released last week. "We are aware that our decision may appear inequitable given the results. We, however, are not free to decide cases based upon our personal preferences but instead must decide them based upon the law."

METAIRIE, La. (AP) ? The New Orleans Saints changed their practice and travel plans Monday, heading for Cincinnati as Tropical Storm Isaac headed for the Gulf Coast.
Interim coach Joe Vitt called off practice and meetings so players could evacuate their families. The Saints also contacted the Cincinnati Bengals and got approval to practice at Paul Brown Stadium on Tuesday afternoon.
The Saints are scheduled to play their final preseason game Thursday in Tennessee. The team considered flying there directly ahead of the storm, but couldn't work out the logistics. Instead, they decided to make a stop in Cincinnati.
"Joe (Vitt), who's kind of running the show now, has been a good friend for a long time," Bengals coach Marvin Lewis said after his team's practice Monday. "So it works out well. We've talked a couple of times already."
Lewis offered to hold a joint workout with the Saints, but New Orleans decided on a separate practice. The Bengals will practice in the morning before heading to Indianapolis for their final preseason game against the Colts on Thursday night.
The latest National Weather Service forecast has Isaac coming ashore on the Mississippi Gulf Coast just east of Louisiana on Tuesday night or Wednesday morning with maximum sustained winds of about 100 mph. Each updated forecast has had the storm landing farther west than the previous one.
Louisiana governor Bobby Jindal declared a state of emergency on Sunday afternoon.
Vitt decided to give his players time to take care of their families. The Saints haven't practiced since their 34-27 preseason win over the Texans on Saturday night in New Orleans. Drew Brees was sharp in that game, going 17 of 25 for 179 yards with a pair of touchdowns.
New Orleans has been scrambling since the path of the storm changed.
"They haven't had an opportunity to have their team back together," Lewis said. "They haven't even looked at the tape of their players (from the preseason game) yet. So they're going to get in here tonight and try to get some of their evaluation done from the last game."
Linebacker Will Herring tweeted a photo of himself cleaning out his freezer in preparation for leaving town.
It'll be the second time the Saints have visited Ohio this month. They opened their preseason in Canton in northern Ohio, beating Arizona in the Hall of Fame game.

Aug 24 (IFR) ? The first so-called real estate owned
(REO)-to-rental securitizations in the United States may go
ahead without credit ratings, as agencies ponder how to assign
grades to the new and potentially risky products.
In the planned deals, real estate and private equity
investors would buy up blocks of foreclosed properties and rent
them out to borrowers who have been displaced due to their
unpaid mortgages. The rental payment streams ? and possibly the
proceeds from an eventual sale of the properties ? would provide
payments to bond investors.
?There are unrated deals in the works,? said Suzanne
Mistretta, a senior director at Fitch.
?Right now investor demand is focused on short-term [two
years or less] unrated offerings, but by next year, we could be
presented with a new rated transaction. Beyond a two-year
average life, investors may want a rating.?
Over the past three months, Fitch, SP, DBRS and Morningstar
have each published initial assessments of the potential risks
of the new asset class. But no agency has yet published official
criteria for the product.
Fitch said that such transactions are unlikely to merit a
rating above Single A ? and even that would require sufficient
historical rental-payment data or a solid record from the
property?s operator/manager.
Moody?s issued its first report on the subject on Thursday,
but said that since it had not seen a formal proposal yet, it
was too early to tell exactly what rating it would assign a
transaction. However, it noted that even extra credit
enhancement would not mitigate a lack of historical
rental-payment data, and therefore some transactions might not
merit top grades.
?We would like to see the specific underwriting criteria
that the operator is using to choose these tenants,? Kruti Muni,
a Moody?s analyst, told IFR.
?Obviously the operators would rely on income information,
the existence of security deposits, history of utility payments,
etc. The diversity of the geography of the pools of homes is
significant as well.?
Moody?s also said that before assigning a rating, it would
need to know detailed information about the operator, and would
conduct a review of the operator?s performance, its experience
and its ability to perform its role in the transaction, which
includes determining tenant default rates and re-leasing
periods.
SP, which published its initial thoughts on the idea in
May, also would not specify a specific rating ceiling, while
Kroll said that it was monitoring the development of the
product.
RISKS INVOLVED
The agencies have spoken to numerous market participants
interested in the idea, but say no potential issuer has yet
presented them with a concrete proposal. However, smaller
unrated deals are already being assembled.
Securitization specialists say that Jefferies and Wells
Fargo, among other banks, are interested in an early rollout of
the product.
Interest in these transactions is rising because the housing
market depression has left financial institutions with a large
inventory of single-family foreclosed properties. At the same
time, demand for family rental homes is rising because mortgage
underwriting is tight and many potential buyers do not qualify
for mortgages. Other buyers have stayed on the sidelines,
waiting for home prices to stabilize.
?Large numbers of displaced homeowners who have defaulted on
their mortgages have no choice but to rent,? Muni said.
Fitch estimates that, in the non-agency sector alone,
distressed inventory ? properties covered by loans that have
been delinquent for 60 days or more ? totalled 1.13 million
units in June, while government-sponsored entity delinquencies
of 60 days or more plus real estate-owned inventory at the end
of the first quarter totaled roughly 1.3 million.
OPPORTUNITY KNOCKS?
With the primary private label RMBS market stalled, the
financing of family rental properties may provide an alternative
investment opportunity for non-agency RMBS buyers.
Several real estate and private equity investors, including
a subsidiary of Colony Capital and Waypoint Homes, have started
buying blocks of foreclosed properties in the hope of becoming
sponsors of such deals. Meanwhile some securitized-debt
investors, particularly those who have already bought
non-performing loan bonds, have expressed interest in the
offerings, the ratings agencies say.
One of the main challenges to completing a rated transaction
is clarity on the criteria used by the individual management
firms to choose which tenants will live in the transformed
properties.
?With FICO scores dropping from foreclosure proceedings,
managers are going to have to think outside the box about a
tenant?s ability to pay,? said Jon Van Gorp, a partner at law
firm Mayer Brown.
Given their recent record with residential mortgage
products, the agencies are cautious before issuing an actual
rating, Van Gorp said.
?Rating agencies must work hard to earn back the trust they
lost during the credit crisis.?

This is a reasonable assessment, especially if we understand that #3 can?t really happen, because unlike Medicare, which went into effect quickly, PPACA has a gradual rollout.
It will be most interesting to see what happens if the GOP gains power in the 2012 elections. Remember, it seemed obvious that President Obama would close down Guantanamo, but once he arrived in office he found it hard to do, even though not following through on his plans make him look bad.
There?s a similar challenge awaiting the GOP. Health care policy can?t just be ignored, but the main Republican ideas are unworkable, counterproductive or inconsequential. Repealing PPACA sounds easy, but something will be needed in its place. And having to seriously propose and actually pass that ?something? won?t be easy, especially when traditional GOP constituencies such as corporations, health insurers and pharmaceutical companies make it clear that they don?t really mind PPACA and would rather just get on with it. And assuming the Congressional Budget Office continues to calculate that PPACA saves money, merely repealing PPACA adds to the deficit.

Bad day for Samsung. The Samsung vs. Apple jury has just finished deliberating and the verdict is out in San Jose. Unfortunately, it looks like Samsung has been found guilty of deliberate patent?infringement?time and time again on many devices spanning multiple carriers. As you may guess, this was never going to be just a simple ?guilty? or ?non guilty? outcome. There was a 700 question form for jurors to answer and as I type this, the verdict is still being read and discussed in court. What we know so far is that Samsung is going to have a rough road ahead with this loss.?

Update: In good news, Samsung?s Galaxy Tab was found not to infringe on the iPad?s design. That?s a big one.

The IP67 certification is truly for this phone, and we recommend the Xperia Go for those who want a truly rugged and all-weather handset.
